KENNETH J. MACARTHUR
After joining the firm in 1994, Mr. MacArthur established an expertise in commercial disputes (including equipment leases and secured transactions), creditors' rights, and consumer financial services litigation.
Mr. MacArthur continues to practice in these areas, and has expanded his focus to include securities, trade secret, unfair competition, and other complex business litigation matters, as well as the representation of clients in arbitration before the NASD, and in connection with SEC enforcement investigations.
Before law school, Mr. MacArthur served as an officer in the U.S. Navy.
Representative Cases
- Representation of Small Business Administration lender in an action against borrower for judicial foreclosure and deficiency judgment, and in the subsequent Chapter 11 bankruptcy
- Representation of equipment lessor in action against lessee and guarantors for recovery of equipment, breach of lease and breach of guaranty
- Defense of lender in action brought by consumer alleging debt collection and credit reporting claims
- Representation of assignee finance company in action for damages under a payment plan agreement by which the defendant had financed the acquisition and licensing of software
